Spurred by record unemployment and high profile cases netting huge settlements and damage awards in recent years, lawsuits brought by employees who were misclassified as exempt (or salaried) have sky rocketed. This program will examine cases brought by employees who demanded unpaid wages resulting in millions in damages. To prevent these costly mistakes, this program will show which employees are exempt vs. non-exempt under federal and state wage and hour laws, how to conduct an internal company audit to determine whether employees have been misclassified and how to correct mistakes. This program will provide practical, step-by-step guidance on time tracking, recordkeeping, allowable deductions from paychecks of exempt vs. non-exempt employees and pay obligations for sick/vacation, overtime, missed meal periods, rest breaks, on-call, reporting, make-up, training and travel time, and alternative work weeks (4 workdays of 10 hours each).

This session will provide employers with the information, tools and resources needed to develop high quality, accurate and detailed job descriptions to be used when recruiting, hiring, and evaluating employees and help prevent common misclassification errors. Learn how to prepare job descriptions that reflect essential job functions, time spent performing work of an exempt nature and the degree of independent judgment and discretion exercised to determine proper classification.
